Terms of Service
These terms govern your use of the StreamTonight mobile application and related services (the "Service"). By installing or using StreamTonight, you agree to these terms. If you don't agree, please don't install or use the app.
1. Who we are
StreamTonight is operated by Matthew Mason, doing business as StreamTonight ("we," "us," "our"), a sole-proprietor business in Washington State, United States. Contact: support@streamtonight.app.
2. The Service
StreamTonight is a mobile application for iOS and Android that surfaces a personalized list of premieres, new episodes, and newly available movies on the streaming services you tell us you subscribe to. We do not stream content ourselves; we provide a discovery layer that points you toward content available on third-party streaming services (Netflix, Max, Hulu, Disney+, etc.). Each streaming service has its own subscription, terms, and content rights, separate from ours.
3. Accounts
StreamTonight does not require you to create an account or provide personal information. We identify your app install via a per-install identifier (see privacy policy). You are responsible for the device you install the app on, the security of that device, and the App Store / Google Play account used to install it.
4. Subscriptions
4.1 Pricing and renewal
StreamTonight offers two subscription tiers: Monthly at $1.99 USD per month and Annual at $14.99 USD per year. Pricing is in U.S. dollars and may differ in local currency on non-U.S. App Store / Play Store storefronts. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple / Google account is charged for renewal at the price in effect at the time of renewal.
4.2 Free trial
New customers receive a 7-day free trial. The trial begins automatically when you first launch the app — you do not need to enter payment information to start. If you do not subscribe before the trial ends, the app's content features become unavailable until you subscribe; nothing is charged. If you subscribe during the trial, the subscription begins immediately at the end of the trial and your Apple / Google account is charged at that time. Each Apple ID / Google account is eligible for one free trial per subscription product, per App Store / Play Store policy.
4.3 Cancellation
You can cancel your subscription anytime:
- iOS: Settings → Subscription → Cancel Subscription, or directly via iOS Settings → [Your Name] → Subscriptions.
- Android: Settings → Subscription → Cancel Subscription, or directly via the Google Play Store → Profile → Payments & subscriptions → Subscriptions.
Cancellation takes effect at the end of the current paid period — you keep access until then. We do not see, and cannot expedite, the cancellation flow; Apple and Google handle it directly.
4.4 Refunds
Refunds are handled by Apple (App Store) or Google (Play Store) per their respective policies. We do not directly process payments and cannot issue refunds. To request one:
- iOS: reportaproblem.apple.com
- Android: Google's refund policy
4.5 Price changes
We reserve the right to change subscription pricing. Existing subscribers will be notified of a price change at least 30 days before the new price takes effect, via in-app notification or email-equivalent. You can cancel before the new price takes effect if you don't agree.
5. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or disassemble the app, except where applicable law permits.
- Scrape, copy, or redistribute the content lists, episode metadata, or other data the app surfaces, except for personal use.
- Use the Service in a way that would violate the terms of any of the streaming services we link to.
- Impersonate StreamTonight or attempt to gain unauthorized access to our backend.
- Submit false, misleading, or harmful information through the support contact channel.
6. Intellectual property
The StreamTonight name, logo, app design, and source code are the property of Matthew Mason DBA StreamTonight. All rights reserved. The names, trademarks, and content of the streaming services we link to (Netflix, Max, Hulu, Disney+, Prime Video, Apple TV+, Peacock, Paramount+, Starz, AMC+, MGM+) are the property of their respective owners; we use those names nominally to refer to those services and are not affiliated with, endorsed by, or sponsored by any of them. Movie and TV show metadata is sourced from The Movie Database (TMDB) under their API license.
7. Disclaimers
The Service is provided "as is." We make best-effort to keep the content lists accurate and timely, but streaming availability changes constantly and we cannot guarantee that any specific show or movie listed in the app will be available on the named service at any given moment. Streaming services frequently add and remove content; that is outside our control.
We do not stream content. Watching the content listed in StreamTonight requires a subscription to the relevant streaming service, which is separate from your StreamTonight subscription.
Push notifications are best-effort. Daily summary notifications depend on Apple's and Google's push delivery infrastructure, which is not guaranteed. Notifications may occasionally be delayed or fail to deliver due to network conditions, OS-level battery optimization, or platform issues.
8. Limitation of liability
To the fullest extent permitted by law, StreamTonight is not liable for any indirect, incidental, consequential, special, or exemplary damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the Service. Our total cumulative liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim, or $20 USD, whichever is greater.
9. Indemnification
You agree to defend, indemnify, and hold harmless Matthew Mason DBA StreamTonight from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Service or violation of these terms.
10. Termination
We may suspend or terminate your access to the Service at any time, for any reason, including breach of these terms. Termination does not entitle you to a refund of any pre-paid subscription fees, except where required by applicable law.
11. Governing law and disputes
These terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws principles. Any dispute arising out of these terms or your use of the Service will be resolved exclusively in the state or federal courts located in Kitsap County, Washington, and you consent to personal jurisdiction there.
If any provision of these terms is held unenforceable, the remaining provisions remain in effect.
12. Changes to these terms
We may update these terms from time to time. Material changes will be announced in-app and reflected in the "Last updated" date above. Continued use of the Service after a change indicates acceptance of the updated terms.
13. App Store and Google Play additional terms
If you installed StreamTonight via the Apple App Store, Apple's Standard EULA also applies, and you acknowledge that Apple has no obligation to provide maintenance or support for the app. If you installed via Google Play, Google's Play Terms of Service also apply.
